General Terms and Conditions for Consumers Bold Addendum

We, Bold Security Technology B.V. (hereinafter referred to as "Bold"), focus on the development and supply of physical access system products, a related mobile application (the "Bold App") and a web application (the “Bold Web Portal”). 

Bold’s Terms and Conditions follows the Thuiswinkel.org legal framework. It is drawn up in consultation with the Consumers’ Association within the framework of the Self-Regulation Coordination Group (CZ) of the Social and Economic Council and has been operable since 1 June 2014. 

Our general terms and conditions ("Terms and Conditions") apply to the purchase and use of our products and services by consumers. Meaning: natural persons not acting in the course of a profession or business. This Article 21 contains trader specific additional terms and conditions and serves as an addendum to the general terms and conditions for consumers:

We recommend that you study these Terms and Conditions carefully before placing an order on our website and using our products and services. You can view the most recent version of these Terms and Conditions on our website. 

Article 21 - Additional Terms and Conditions from trader

In addition to Article 11:

  1. Any shipping costs are displayed on the Website and will be shown before placing the order. 
  2. Bold may change its prices at any time, but these price changes do not affect current or previous orders that Bold has accepted. 
  3. Bold accepts payments by means of credit cards or online payment systems, such as PayPal and online banking. Any additional related costs are at the expense of the Client.

In addition to Article 12:

  1. For any Bold product the statutory warranty period of 24 months applies. Bold product warranty is non-transferable to new owners (so called second-hand products).
  2. If any Bold product that is purchased does not work as it should, the Client may be entitled to have this product repaired or replaced by Bold, or to receive a proportionate reduction in the purchase price. A Client can claim the above rights if the ordered Bold Product is not fit for its purpose. However, a product is not unfit for its purpose if a defect is the result of not following our clear measuring or installation instructions. 
  3. Bold has the right to oppose a solution requested by the Client if it is either impossible or unreasonable, for example if the cost of repair exceeds the cost of a new product. If (i) we are unable to repair or replace the Product, (ii) we refuse the repair or replacement or are unable to carry it out within a reasonable time, (iii) the repair or replacement is unreasonable or inconvenient for you or (iv) the repair or replacement is unreasonable for you for valid reasons in our opinion, you may claim a price reduction or rescission of the contract.

In addition to Article 13:

  1. If the order cannot be delivered due to circumstances attributable to the Client (e.g. providing an incorrect address), Bold may cancel the order within 30 days of the last attempt. Or Bold can deliver the order to a designated collection point so that you can collect the product yourself. The Client will be informed of the delivery status by means of e-mail updates. If Bold cancels the order, payments made by the Client will be refunded to you without undue delay.
  2. Bold may cancel the order if Bold suppliers do not deliver the ordered products to us, without this being due to, caused by or foreseeable for us. If this situation occurs, we will inform the Client thereof. Bold will refund any payments already or alternatively, will offer the customer a voucher without any unnecessary delay.
  3. On the Bold Website the Client can buy the Bold Products. Our ordering process gives the Client the opportunity to check and adjust any errors before you place the final order. Select any Bold Product by clicking on the [BUY] button and then the [IN SHOPPING CART] button. One can also remove selected products from the shopping cart and replace them by pressing the [X] button or adjust the number of products shown in the shopping cart. Please carefully check the order and the information the Client provides before placing the order. By clicking on the [Place order] button, the Client makes a binding offer to buy. 
  4. Bold has the right to refuse orders without giving any reason, especially if the product ordered is no longer available. Bold strives to ship ordered products as soon as possible.
  5. If the Client places an order before 8pm (GMT +1) on a working day, Bold strives to ship it the same working day, provided the products are in stock. If ordered after 8pm (GMT +1) on a working day, Bold strives to ship the order the next working day. 
  6. If Bold does not have all the ordered products in stock, Bold may choose to deliver the order in parts. Any terms such as delivery terms or the revocation period only start to run once the last partial delivery has taken place.

In addition to the overall General Terms and Conditions:

  1. The Terms and Conditions may be changed by Bold at any time. Client orders are subject to the Terms and Conditions in force at the time of the order. 
  2. Bold may add to or modify its products and services, including the Bold Products, Website, Bold Web Portal and Bold App. Bold will do its best to inform you of any material changes. 
  3. To the extent permitted by mandatory law, the rest of the agreement remains valid if any provision of these Terms and Conditions is nullified, nullified or found to be invalid. The relevant legal provisions shall apply instead of the annulled, void or unenforceable provisions. 
  4. Bold always tries to resolve differences of opinion with our customers in mutual consultation. Bold advises to contact Bold Support (support@boldsmartlock.com) if you are not satisfied with the products or services. 
  5. The European Commission has set up a dispute resolution platform to collect any consumer complaints following an online purchase and forward them to the relevant national mediators. This platform can be accessed here: http://ec.europa.eu/consumers/odr

  7. The Client may from time to time provide Bold with comments, suggestions, data, information or feedback ("Feedback") on the Bold Products, Bold Web Portal, Bold App, Website or other products and services offered by Bold. The Client acknowledges and agrees that such Feedback may be freely used by Bold in its sole discretion for the design, development, improvement, marketing and commercialisation of the Bold Products, Bold Web Portal, Bold App, Website or other products and services offered by Bold, without any restriction based on confidentiality or intellectual property rights. The Client further agrees that Bold may use any information sent with a warranty claim from the Client as Feedback.
